Definitions

The following terms and conditions document is a legal agreement between Designs By J9 hereafter “Developer” and “Client” for the purposes of website design, graphic design or web development. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.

The Developer: An Internet web design provider offering the Client graphical design, HTML, CSS, JavaScript and other related computer programming languages.

The Client: The company or individual requesting the services of Designs By J9.

General

Designs By J9 will carry out work only where an agreement is provided either by email, telephone, mail or fax. Designs By J9 will carry out work only for clients who are 18 years of age or above. An ‘order’ is deemed to be a written or verbal contract between Designs By J9 and the client; this includes telephone and email agreements.

Website & Graphic Design

A Non-Refundable deposit as per agreement between the client and Designs By J9 is required with all of our projects before any design work will be carried out.

The website, graphics and any programming code remain the property of Designs By J9 until all outstanding accounts and payments are paid in full.

Any additions to briefs provided will be carried out at the discretion of Designs By J9 and where no charge is made by Designs By J9 for such additions, Designs By J9 accepts no responsibility to ensure such additions are error-free and reserves the right to charge an according amount for any correction to these or further additions.

The client agrees to make available as soon as is reasonably possible to Designs By J9 all materials required to complete the site to the agreed standard and within the set deadline.

Designs By J9 will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Designs By J9 will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

Once a website or any other work has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e. If the client decides they no longer want the site or design work, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non-payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the client’s satisfaction no refunds can be offered and any additions will be charged accordingly.

Special Offers

  1. Limited Time Offers: Our special offers are available for a limited time only. We reserve the right to determine the duration of these offers, and they may be subject to change or termination at any time, at our discretion, without prior notice.

  2. Discretionary Sale End: The end date of any special offer will be determined solely by us. We may choose to extend or conclude the offer at any time, without providing advance notice.

  3. Non-Conjunction of Specials: Special offers cannot be used in conjunction with each other unless explicitly stated otherwise in the offer details. Customers are limited to redeeming one special offer per transaction.
Rights to Refuse Service

We reserve the right to refuse service to anyone, for any reason, without explanation. We are committed to providing a safe and enjoyable shopping experience for all customers, and we may exercise this right to ensure the comfort and security of our staff and patrons.
